Part A – General Terms for all Users
- These Terms constitute a legally binding agreement between you and Job Matcher. These Terms apply to all Users. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree, you may not access or use our Site.
- The establishment of an Account with Job Matcher is limited to individuals over the age of 18 years and who reside in Australia. By establishing an Account with Job Matcher, you warrant and represent to Job Matcher that you are over the age of 18 years and reside in Australia.
- The Terms hereby incorporate by reference any additional terms and conditions posted by Job Matcher, including subscription and service specific terms and conditions. Unless otherwise indicated, the Terms apply to all Users of the Site. These Terms prevail over any additional terms and conditions, to the extent of any inconsistency.
- For information on how Job Matcher uses and discloses your Personal Information (amongst other things), please read our Privacy Policy which is published at https://jobmatcher.app/privacy. By accessing or using the Site, you also represent that you have read, understood and agree to our Privacy Policy.
- If you are accessing or using the Site in your capacity as an employee, contractor or agent of an Employer, you agree to the Terms on behalf of yourself and such Employer, and you represent and warrant that you have the authority to bind such Employer to the Terms.
- We note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers or people acting under false pretences. You assume all risks associated with dealing with other Users with whom you come in contact through our Site. User Content on our Site may be offensive, harmful, deceptive and/or inaccurate. We recommend that you exercise caution when using our Site and only provide Personal Information to the extent it is required for initial recruitment purposes.
- You are solely responsible for all content on your Profile. You must ensure your content is accurate, non-discriminatory, and complies with all applicable laws, including employment laws, health and safety laws, anti-discrimination and privacy laws. We may reject or remove any information submitted or on your Profile acting reasonably, including any unlawful or offensive content.
- You are solely responsible for the confidentiality and use of your Account credentials and Account access, which may not be shared with others. If you intentionally or negligently allow any other person to access or use your Account, you are, to the maximum extent permitted by law, fully responsible for all actions taken through your Account. This includes any transactions, communications, or agreements entered into by such third parties, which shall be deemed binding on you as if you had taken such actions yourself.
- We may reject, remove, or limit the visibility of any User Content, and we may disable any Account or restrict your ability to use all or parts of the Site, on reasonable grounds and without notice to you. Although we may indicate reasons for such a decision, we cannot always do so. We reserve the right to make such decisions in our interest or in the interests of one or more Users.
- Job Matcher does not and will not serve as an agent for any User. Job Matcher expressly rejects delegation to Job Matcher of any decision-making authority by any User. Job Matcher offers the Site to you strictly for your consideration and your decision-making. You are solely responsible for your Account and your use of the Site, and your access to and use of the Site is conditioned on your agreement that you will not use the Site, in whole or in part, as a substitute for your own independent judgment or decision-making at any step. Job Matcher is not responsible and disclaims all liability for any actions taken or not taken based in whole or in part on any information you submit or receive in connection with your use of the Site.
- You acknowledge and agree Job Matcher does not and cannot act as, or provide the services of, an employment agency to any Employer or Job Seeker. An employment agency works directly and individually with job seekers to understand and verify their qualifications and/or with employers to understand and verify their business needs and job-related qualifications. Job Matcher does not and cannot do this. Job Matcher is a publisher of information that provides tools for Employers and Job Seekers to find and evaluate the information published by one another. Job Matcher expressly refuses to determine or recommend whether any Employer or Job Seeker should further consider or take any other steps in regard to one another. While Job Matcher may provide tools or information for Users to consider in determining this for themselves, all Users are forbidden from using these tools or information in place of their own judgment or decision-making.
- You acknowledge and agree that Job Matcher has no obligation to screen any Employers or Job Seeker Profiles, or to include any Job Seeker Profiles, in its search results or other listings, and may, acting reasonably, exclude or remove any Job Seeker Profiles from the Site or your search result without any obligation to provide reasoning for removal or exclusion.
- You acknowledge and agree Job Matcher may require Users to verify their email address and/or phone number. This may be conducted through a third-party service provider. You agree that any such service provider is separate from Job Matcher. This third-party service provider will be responsible for their collection, use, storage, processing or loss of data you provide to them, and any related legal obligations.
- To the maximum extent permitted by law, Job Matcher is not responsible for and disclaims all liability if your Account credentials are used improperly or falsely by a third party.
- To the maximum extent permitted by law, we do not guarantee the error-free functionality of the Site, email delivery, or any other error-free data transmission or storage. Job Matcher may provide you with notifications, but they are a courtesy and should not be a substitute from logging onto the Site. In the event a message being sent is intended for a closed Account, these messages will not be deliverable.
- Competitors of Job Matcher (or their employees, contractors or agents, acting on behalf of such entities) may not use the Site to contact Job Seekers or Employers other than for bona fide internal recruitment purposes. We reserve the right to cancel the access of any User using the Site in contravention of this provision.
- Job Matcher has no control over the identity of Employers, the identity of Job Seekers, User Content, any employment terms and conditions offered by an Employer to a Job Seeker or the content of any linked third-party website. By leaving Job Matcher for a third-party website, you accept their terms. Job Seeker Profiles contained on, or linked from, the Site are indexed and posted in an automated manner. Job Matcher cannot guarantee, and (to the maximum extent permitted by law) disclaims all liability for, any User Content submitted by any Employer or User, including the accuracy, completeness, legality, reliability, legitimacy, truthfulness, or availability of such content. Job Matcher does not guarantee the identity of any Employer or User.
- When using the Site, you agree to your activities, communication, materials, and content being recorded, processed, analysed, reviewed, and stored, including via automated means, for data analysis, quality control, enforcement of these Terms and other Job Matcher policies, content moderation, and to improve the Site or any other Job Matcher service. We use such data about your activities, communication, materials and content to develop, train, build, and use statistical models, including artificial intelligence and machine learning models. Job Matcher also uses third party service providers to collect, record, process, analyse, and store activity and such data and content. In accordance with Job Matcher’s Privacy Policy and as permitted by applicable privacy laws, we may use personal information to improve our services, including by developing, training, improving, building, and using artificial intelligence, including statistical and machine learning models.
- By registering for an Account, you agree to receive mandatory email updates regarding activity on your Account.
- The Site contains AI-Generated Content. The use of AI-Generated Content is entirely at your own risk. AI-Generated Content may not accurately reflect real people, places, or facts. You must evaluate AI-Generated Content for accuracy and appropriateness for your use case, including using human review as appropriate, before using or sharing AI-Generated Content generated through Job Matcher. You acknowledge and agree that Job Matcher provides an interactive service and shall not be treated as the publisher or speaker of AI-Generated Content, which is generated by a machine-learning model which will be provided by a third party.
- To maintain the quality of the Site, Job Matcher in its sole discretion may impose limits on your use of the Site. Your use of any automation, scripting, or bots to automate any Job Matcher process outside of Job Matcher’s tooling is prohibited.
- By uploading or inputting User Content to the Site, you acknowledge and agree such material may be lost or permanently deleted after a reasonable period of time determined by us, acting reasonably. Such material may also be corrupted or lost other than due to an act or omission of Job Matcher. As such, you are responsible for keeping your own copies of such material.
- You must not use the Site for any directly or indirectly illegal, discriminatory, fraudulent purpose, unethical or offensive purpose. You agree not to use the Site to engage in unlawful activities, generate or disseminate harmful, offensive, or misleading content, generate or disseminate financial, legal, or medical advice, or attempt to manipulate, exploit, or interfere with the Site or any other services provided by Job Matcher. You agree not to use the Site for any or other harmful purposes, including testing the Site to exploit vulnerabilities or misusing outputs to create misleading, illegal, or harmful content or actions. You agree that you will not reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any source code or any portion of the Site.
- The Site is an interactive online service and Job Matcher has no obligation to host, publish, monitor, or remove any particular User Content. Job Matcher may, acting reasonably, reject, remove, or limit the visibility of any User Content without notice. We reserve the right to make such decisions in our interest or in the interests of one or more Users.
- To the maximum extent permitted by law, Job Matcher disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, operability, or availability of information on or linked from the Site (including Job Seeker Profiles and User Content), whether paid or free. Job Matcher does not guarantee the Site will be safe, or secure. To the maximum extent permitted by law, Job Matcher liable for your use of any linked third-party sites or services.
- You must comply with the below Site rules. Failure to comply is a breach of the Terms. We may, without notice, take measures against Users violating rules, including content removal, service restrictions, logging out or cancelling relevant Accounts. You must not, in connection with your use of the Site:
- Access the Site through any means other than the public interfaces provided by Job Matcher.
- Access any data, including Personal Information, by automated means, with our written consent.
- Provide any false or fake information, impersonate any person or entity or create a fake Account.
- Provide any instructions, system prompts, code, or data with the intent or effect of damaging, disrupting, disabling, harming, impairing, interfering with, manipulating, altering, intercepting, expropriating, or otherwise impeding the proper or intended functioning of the Site, or any data, program, system, services, equipment or communication.
- Bypass any security measures or Site limitations.
- Advertise goods or services through the Site.
- Use our services with the intent or effect of damaging, disrupting, disabling, harming, impairing, interfering with, intercepting, expropriating or otherwise impeding our services, the appearance of our services, the Site, or any systems.
- Use the Site, including AI-Generated Content, to harm or violate the rights of any person.
- Use or misappropriate the Site for your own commercial gain.
- Use any automated system (bots, scrapers, spiders, AI or agentic AI) to access, data-mine, or submit content to the Site, in bulk or otherwise, without Job Matcher’s prior written consent.
- Crawl, scrape, extract data from, reproduce, duplicate, copy, sell, exploit, trade or resell any part of the Site or access the Site for the development, training, fine-tuning, or improvement of any third-party machine learning model, AI system, or any related software program, model, algorithm, or generative AI tool.
- Generate or provide User Content that is unlawful, fraudulent, discriminatory, threatening, abusive, defamatory, obscene, harmful, harassing, violent, hateful, irrelevant, unconstructive, or otherwise objectionable; promotes self-harm; contains sexual, ethnic, racial, or other discriminating slurs; contains proprietary information, trade secrets, intellectual property of another person, or confidential information; or contains spam, pyramid schemes, or unsolicited commercial communications.
- Generate or use malware.
- Post official identification numbers, background check information, or other highly confidential data that violates or may violate anyone’s privacy rights.
- Submit User Content by automated means, in bulk or otherwise, other than by automated tools that the Site offers.
- Submit User Content (including website links) that is malicious, fraudulent or spam.
- Interfere with other Users use of the Site.
- Modify, adapt, translate, reformat, resell, frame, or reverse engineer any portion of the Site.
- Promote or encourage illegal activity.
- Send unsolicited commercial messages, or any other unlawful communications.
- Communicate with any Users or prior Users who have asked not to be contacted by you.
- Communicate with any Users for a reason which does not relate to recruitment or employment.
We reserve the right to use technical measures to detect, investigate, or prevent unauthorised automated access or activity on the Site. Job Matcher reserves the right to monitor all activity on the Site and to not pass on or deliver any message or communication that may be malicious, spam, fraudulent, or unwanted, or for any other reason.
Part B – Terms applying to Job Seekers
- If you access or use the Site as a Job Seeker, you agree to be bound by this Part B.
- As a Job Seeker, you are permitted to use the Site and its content for your personal, non-commercial purpose of seeking employment or information related to your job search. You agree that your license to use the Site is automatically revoked upon your attempt to use the Site for any other purpose.
- When you apply to a job or otherwise interact with an Employer through the Site, you agree and understand that only the Employer, and not Job Matcher, makes any decision in the recruitment and hiring processes, including deciding whether to advance any applicant to any next stage such as an interview and deciding whether to hire any applicant.
Job Seeker Profiles, matching and recommended Job Seekers
- Job Matcher displays Job Seeker Profiles based on searches conducted by Employers, relevance and other information provided and activities conducted on the Site by its Users.
- We may, in our sole discretion, add labels or badges to your Job Seeker Profile based on your activities on, and interactions with, the Site. Such content may be AI-Generated Content.
- Job matches are recommendations which may be presented to both you as a Job Seeker and to Employers in various formats on the Site. The purpose of presenting matches is to allow Users to make their own decisions regarding employment opportunities. For example, we may recommend you to an Employer if you are similar to other Job Seekers to which an Employer recently searched for or recommend you to an Employer who requires a suitable role to be filled. To generate matches, we use data and information collected through our Site from both Employers and Job Seekers. This includes Job Seeker Profiles, Employer Profiles, User Content and the activity of Job Seekers and Employers on the Site (such as searches an Employer runs and Job Seeker Profiles an Employer clicks on and contacts).
- Job Matcher offers many of its services for free, especially for Job Seekers. We may start charging for such services, restrict their use, or add them to other services or features in our sole discretion.
Profiles and Resume
- By creating or adding information to your Profile through the Site, creating a Resume, or uploading a Resume on the Site (Job Seeker Material), you authorise Job Matcher to make your Job Seeker Material available to Employers and Users of Job Matcher’s searching functions. Your Profile includes any information you provide on the Site in the “Profile” section of your Account, including Personal Information, your Resume and any other information that you choose to provide on the Site, including job preferences, desired job title, work schedule, licenses, certifications and qualifications.
- You can decide whether some aspects of your Job Seeker Material can be viewed by Employers by changing the settings on your Profile. Changing these settings or any other privacy settings will not affect prevent Employers you have already been in contact with from reaching you. We note that even if your Profile is set to “not searchable” or similar, search engines and other third parties may have copied your Profile and made it available elsewhere, and Job Matcher has no control over such third parties. To the maximum extent permitted by law, Job Matcher disclaims all liability for your Profile and information shared with Employers or made public.
- We do not guarantee your Profile will be shown to any specific Employer or that it will always be available for an Employer to review. We reserve the right to limit or change your Profile’s visibility or accessibility, acting reasonably.
- By providing your contact details (including phone number and email address) in your Job Seeker Material, you agree that these contact details may be shared with Employers, and Employers may be provided with the ability to contact you using these contact details.
- Job Matcher may mask information contained in your Job Seeker Material, acting reasonably. Job Matcher may also mask Employer contact information, or Employers may choose to do so. You agree to be contacted by Employers using masked numbers/emails and may not be able to return these calls or emails.
- You are solely responsible for the accuracy and content of your Job Seeker Material. You are responsible for keeping your Job Seeker Material up-to-date. We recommend that you do not include any sensitive Personal Information in your Job Seeker Material you do not want to be made public, such as financial details, residential addresses, ID document numbers and health information. If we find sensitive Personal Information on your Job Seeker Material, we may mask it, but we cannot guarantee this.
- We may provide feedback on your Job Seeker Material, including suggestions for improvement. By creating or adding information or documents to your Profile, you are requesting and authorising us, to review or scan your Profile and Resume(s) and provide you feedback (at our discretion). This is for informational purposes only and does not guarantee results. You are solely responsible for deciding what information to include in your Job Seeker Material.
- Employers may request us to assemble Job Seeker Material into a single document, and you authorise us to do so. You acknowledge and agree that Employers may also use tools, including artificial intelligence and machine learning models, to process, sort, and analyse Job Seeker Material. The function of these tools may include generating summaries, translations, and other information, which Employers can use or discard as part of their decision-making process.
- After you permit an Employer to contact you, we cannot prevent this Employer from contacting you in the future. You will be responsible to procure that the Employer no longer contacts you, if this is your wish.
- We do not control or review Employers, their recruitment processes or employment practises. Employers, and not Job Matcher, decide which qualifications are relevant for which job, who is qualified for a job (or not), and who moves forward (or does not) in the process. When your Job Seeker Material is shared, the Employer’s use of that Job Seeker Material is governed by their policies. Any request to delete or modify your information must be made directly to the Employer. Job Matcher is not responsible for Employer- content or Employer communications with you. Employers are solely responsible for compliance with all applicable laws, including employment, taxation, superannuation, anti-discrimination, health and safety and privacy laws, when recruiting and/or employing you.
- We do not guarantee the validity of any employment offer made to you in connection with the Site and recommends that you verify the validity of an employment offer before taking any action, including regarding your current employment. You are solely responsible for verifying the accuracy or legitimacy of any employment offer or Employer.
- Job Matcher may notify you about Employer actions related to your Profile, including viewing, sending, storing, receiving, pausing, closing, opening, responding to, or making decisions. These notifications, delivered via the Site, text message, email, or on the Job Matcher platform, are a courtesy only and may not be accurate.
Your activities and interactions
- You agree that in addition to making your Profile available to other Employers, we may inform Employers about your activities on, and interaction with, the Site and is Users, including through labels, badges, or other means. We may let them know your status (like if you’re online or recently active), or if you are responding to their messages or are responsive to messages generally. We solely determine how such labels or badges are added and which Job Seekers may qualify for same based on their activities and interactions with the Site. Job Matcher does not guarantee the accuracy of any such label or badge, and reserves the right to change or remove such label or badge features at any time and in Job Matcher’s sole discretion.
- You agree that any data contained in or associated with your Profile may be used to suggest your Profile to Employers that might be interested in a person who matches your qualifications and preferences on the Site. When you make changes to your Profile, including updating, deleting, or changing settings, it may take a few days for the changes to be reflected.
Part C: Terms for Employers
- If you access or use the Site as an Employer, you agree to be bound by this Section C.
- You are solely responsible for your Account, your use of the Site, your use any Job Matcher services offered on the Site, your decisions regarding job descriptions, job requirements and all content on your Profile, and compliance with laws which apply to recruitment, employment, taxation and superannuation.
- Your Account may only be used for legitimate recruitment purposes and not for any other purpose. You acknowledge you are solely responsible for any decisions relating to a Job Seeker, including selecting or evaluating Job Seekers, advancing or not advancing any Job Seeker to any step such as an interview, and hiring or not hiring any Job Seeker.
- We may provide you with Job Seeker suggestions and this will be without any warranty or guarantee. You use this information at your own discretion and are solely responsible for your use of the Site, compliance with laws, and hiring decisions. To the maximum extent permitted by law, we are not responsible and disclaim all liability for actions taken or not taken based in whole or in part on our suggestions, information, and recommendations.
- By using these and other candidate management tools, you acknowledge and agree that Job Matcher is not procuring employees or candidates for you and Job Matcher does not act as your employment agency or agent.
- You are responsible for all contact with a Job Seeker, both on and off the Site. You are responsible for ensuring that all such contact and related conduct comply with all applicable laws.
- We may promote select Job Seeker Profiles on the Site. When Job Seeker Profile is found on certain pages or filters, it doesn’t mean the Job Seeker has any special qualities. We may not list every Job Seeker Profile, and no inferences should be made about Job Seekers that are not listed.
Subscription and payments
- You agree to pay for all services purchased through your Account, in accordance with the payment terms specified at the time of purchase through the Site and applicable provisions within these Terms.
- Cancellation of your subscription shall be in accordance with any cancellation policy listed on the Site. When you cancel or downgrade your subscription, your access to the Site’s features will change accordingly. You acknowledge and agree that your subscription will automatically renew and Job Matcher will charge you on a recurring basis until you cancel your subscription or plan and such cancellation goes into effect, which may not be until the next billing cycle. Pausing your subscription does not cancel it. Your subscription will continue to automatically renew after being un-paused. The applicable billing cycle (e.g. monthly or annual, etc.) will depend upon the terms agreed upon. Purchasing additional subscriptions or modifying subscriptions may reset the monthly billing date for subscriptions or plans associated with your Account, resulting in pro rata charges to Account for the new date.
- If your Account has a credit card or other payment method on file, such as bank account information direct debits, Job Matcher may charge that payment method for any subscription fees and for any outstanding payments, including to correct billing errors. By providing your bank account information and signing up for direct debits from Job Matcher, you authorise Job Matcher to debit the bank account specified for any amount owed for charges arising from your use of our services, until this authorisation is revoked.
Job Matcher tools and functionality
- Employers may search for and contact a Job Seeker who has made aspects of their Profile and Resume searchable.
- You are solely responsible for verifying all information provided by a Job Seeker, including licenses, certifications and qualifications. Job Matcher does not guarantee the accuracy of any information provided by a Job Seeker.
- We may present you with Job Seekers Profiles and Resumes which may match jobs you are seeking to fill. To generate matches, we use data collected through our Site from both Employers and Job Seekers. This includes Job Seeker Profiles and Resumes and User activity on the Site. You are free to disregard such matches and are ultimately responsible for your sourcing and screening decisions.
- We may provide you with Job Seeker summaries, using information obtained from you and Job Seekers. Such summaries are not recommendations. You must review Job Seekers carefully and not make hiring decisions based on such summaries or any other Job Matcher tools. Employers are responsible for verifying information on the Site, including information provided by Job Seekers. Job Matcher may offer tools which group Job Seekers together based on whether they meet or may meet your criteria, based on information supplied by Job Seekers. You agree that such tools do not constitute or contribute to a decision and is not a substitute for human discretion and review. You agree not to use any tool or functionality provided by Job Matcher as the sole factor, as a factor weighted more than other factors, or to modify or overrule conclusions derived from other factors, in your decision-making, recruitment, or hiring processes.
- Job Matcher may use AI and machine learning models to provide AI-powered assistance, including assisting with identifying Job Seekers based on your job requirements and queries, and providing Job Seeker summaries. While we take reasonable steps to help ensure accuracy and appropriateness of the content and information generated by AI on the site, as with all AI services, we may make mistakes. You are solely responsible for reviewing the suitability of such content and information. To the maximum extent permitted by law, Job Matcher is not responsible and disclaims all liability for actions taken or not taken based in whole or in part on any information you receive in connection with your use of AI-powered assistance.
Part D – Intellectual property, limitation of liability, your indemnification of Job Matcher, tracking your use of the Site and other matters
- You acknowledge that Job Matcher owns all proprietary rights, title and interest in the Site, including in compilations of information available through the Site. Job Matcher, Job Matcher trademarks, service marks, graphics and logos are trademarks or registered trademarks of Job Matcher.
- When you provide User Content, you grant Job Matcher a non-exclusive, worldwide, perpetual, fully paid, royalty-free, transferable, and sublicensable (through multiple layers of sublicensees) right and licence to make, use, sell, sublicence, reformat, reproduce, distribute, perform, display, prepare derivative works from and otherwise exploit your User Content for the purpose of publishing material on the Site or third party websites, maintaining or improving the Site (including for the purposes of training a model that recommends content to other Users), and promoting Job Matcher and such User Content without restriction. To the maximum extent permitted by law, you waive any right to compensation for Job Matcher’s exercise of these rights. This licence will terminate within a reasonable time after the relevant User Content has been removed from the Site. Furthermore, you grant to Job Matcher, its affiliates, and sublicensees a license to use your name, username, and trademarks and logos in connection with any such User Content, any Job Matcher marketing materials containing or incorporating such User Content, or any actions by Job Matcher to promote or publicise such User Content (e.g. Job Seeker Profiles), such as the use of keywords in third-party internet search engines.
- To any extent that such User Content contains your name, likeness, voice or image, you hereby irrevocably waive all legal and equitable rights relating to claims for violation of your rights of publicity (or any similar claims) arising directly or indirectly from Job Matcher’s exercise of its rights pursuant to the licence granted above.
- You represent and warrant that you own your User Content or have the right to grant this licence, and that its use by Job Matcher will not violate any law or infringe on the rights of any third party or result in any breach of contract between you and any third party.
- You may provide feedback including suggest improvements to Job Matcher. We may use this feedback freely, without compensation, and disclose it non-confidentially. You grant Job Matcher a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, distribute, and exploit all feedback for any purpose. Job Matcher may disclose or sublicense feedback to any third party. Accepting feedback doesn’t waive Job Matcher’s rights to similar ideas from other sources.
- By using the Site, you authorise Job Matcher to collect, record, process, analyse, and store (including via automated means) all your activities, interactions, and communications on or through the Site. This includes visited URLs, viewed content, input info, clicks, scrolls, hovers, and time spent. This data about your activities, interactions, and communications on or through the Site is used for analysis, quality control, policy enforcement, content moderation, and to improve the Site and other Job Matcher services. We use third party service providers as an extension of the Site to collect, record, process, analyse, and store this data. You authorise Job Matcher to use this data, your User Content, and AI-Generated Content to develop and train AI/machine learning models, without compensation.
- You may cancel your Account at any time. Subscription fees may still be payable following this time.
We may suspend your Account immediately at our reasonable discretion if we reasonably believe you have breached these Terms or otherwise engaging in unlawful or inappropriate conduct while using the Site. We may cancel your Account immediately if you repudiate the agreement under these Terms or commit a breach of any provision of these Terms which is incapable of remedy. We may cancel your Account if breach any of your obligations under these Terms and fail to remedy such breach within 14 days of us notifying you of the breach of the breach and requiring you to remedy that breach.
The suspension or cancellation of your Account and your right to use the Site shall not affect either party’s rights or liabilities.
All provisions of the Terms that by their nature should survive termination will survive termination, including indemnities, limitation of liability, intellectual property, payment obligations and intellectual property.
- You indemnify Job Matcher (and each of Job Matcher’s employees, officers and agents, for whom Job Matcher holds the benefit of this indemnity in trust) (Indemnified Persons) against all Losses suffered or incurred by any of the Indemnified Persons which arise directly or indirectly out of:
- any User Content or other material you provide to our Site;
- your use of any Content on the Site;
- any breach of these Terms by you or your employees, contractors or agents acting on your behalf or otherwise under your direction;
- any negligent act or omission by you, your employees, contractors acting on your behalf or under your direction; and
- fraud, or fraudulent misrepresentation, wilful misconduct or repudiation of these Terms by you, your employees, contractors or agents acting on your behalf or otherwise under your direction.
Your obligation to indemnify Indemnified Persons under this provision reduces proportionately to the extent that Job Matcher caused or contributed to the relevant Loss.
- To the maximum extent permitted by law, we are not responsible for User Content, the quality, safety or legality of the jobs which may be offered in connection with the Site, the ability of Job Seekers to fill employment opportunities and we make no representations about any Profiles, Resumes or other User Content on our Site.
- We do not endorse or recommend any of the User Content or Job Seeker Profiles on our Site and we recommend that prior to entering into any employment contract (whether as a Job Seeker or as an Employer), that you obtain your own independent legal, accounting, financial and/or taxation advice as is appropriate.
- Our Site may also provide content from other internet sites or resources and while we try to ensure that material included on our Site is correct, reputable and of high quality, we do not make any warranties or guarantees in relation to that content. If we are informed of any inaccuracies in the material on our Site we will attempt to correct the inaccuracies as soon as we reasonably can.
- Our Site and Content may contain inaccuracies or typographical errors. We make no representations about the accuracy, reliability, completeness, or timeliness of any of our Site or the Content on it. The use of any of our Site and the Content on it is at your own risk.
- Nothing on our websites and apps shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regard to its websites, products, services, hiring, experience, employment or recruiting practices, or otherwise.
- While we take reasonable care in ensuring the integrity of User Content, it remains possible that User Content may be unlawfully observed by a third party while in transit over the internet or while stored on our systems or on our Site. We disclaim all liability to you to the greatest extent possible pursuant to law should this occur.
- If we are in breach of these Terms or have any other legal liability to you (to the extent it cannot be excluded under law), we will only be responsible for any losses that you suffer as a direct result and to the extent that they are a foreseeable consequence to both of us at the time you use our Site. To the maximum extent permitted by law, our liability to you will not include commercial or organisational losses such as lost data, lost profits or business interruption.
- To the maximum extent permitted by law, our liability under or in connection with these Terms which cannot be excluded by law, is limited at our option to either, the supply of the services (or the equivalent services) again or the payment of the cost of having the services supplied again.
- If any provision of these Terms is void, voidable by a party, unenforceable or illegal it is to be read down so as to be valid and enforceable or, if it cannot be read down, the provision is or, where possible, the offending words are to be severed from these Terms without affecting the validity or enforceability of the remaining provisions (or parts of those provisions) of these Terms.
- You may not transfer any of your rights or obligations under these Terms to any other person. We may transfer our rights or obligations under these Terms to another business where we reasonably believe your rights will not be materially affected. If you breach these Terms and we do not act, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms.
- To the fullest extent permitted by law, we will not be responsible for any breach of these Terms caused by circumstances beyond our reasonable control.
- We may revise these Terms from time to time in our discretion, for example to accurately describe and cover updated Job Matcher services, to comply with legal or regulatory requirements, or to prevent abuse or harm through the Site. The revised version of these Terms will be published on the Site and will apply to you. If revisions to these Terms will be materially detrimental to Users collectively, we will provide written notice on our Site of the revisions at least 30 days prior to the revisions taking effect, except in urgent or emergency situations like complying with legal requirements or stopping ongoing abuse. If you do not wish to accept the revised Terms, you may not continue to use our Site. If you continue to use our Site, your use will constitute your agreement to be bound by the revised Terms.
- We may, upon reasonable notice, modify or discontinue all or part of the Site, increase subscription fees required to use the Site, or offer services through the Site to some or all Users.
- You may not assign, transfer or delegate any of your rights or obligations hereunder without Job Matcher’s prior written consent. Job Matcher may freely assign, transfer or delegate its rights and obligations hereunder without notice to you. Any reference to Job Matcher shall include reference to any successors, transferors or assigns of Job Matcher.
- These Terms are governed by the law in force in the state of Victoria. The parties submit to the non-exclusive jurisdiction of courts of the state of Victoria and any courts that may hear appeals from those courts about any proceedings in connection with these Terms.
Part E – Definitions
Account means a registered account to use and interact with the Site created and maintained by a User.
AI means artificial intelligence.
AI-Generated Content means Content created in whole or in part by an algorithm, including artificial intelligence and machine learning models, which may be generated in response to information you provide. AI-Generated Content may include chatbots, agentic AI, draft Resumes, career recommendations, messages, questions, highlights, or summaries.
Content includes all text, graphics, design, programming, information, images, video, audio files, software and other content.
Employer means an individual or organisation using the Site in order to recruit Job Seekers, make information available regarding employment opportunities or employment openings, or otherwise obtain information related to hiring or human resources. This includes agencies purchasing for multiple parties and employment agencies, and any authorised User managing or using an Employer’s Account or acting on behalf of an Employer.
Job Seeker means an individual searching for or applying for employment openings, or using or accessing services or information or posting information on the Site related to their personal employment or job search.
Job Matcher, we or us means Your Training Zone Pty Ltd (ACN 607 484 855) (ABN 90 607 484 855).
Loss includes any debt, obligation, cost (including legal costs, deductibles or increased premiums), expense, loss, damage, compensation, charge or liability of any kind, actual, prospective or contingent and whether or not currently ascertainable and whether arising under or for breach of contract, in tort (including negligence), restitution, pursuant to statute or otherwise at law.
Personal Information means information defined as personal information under the Privacy Laws.
Privacy Laws mean
- the Privacy Act 1988 (Cth) and the Australian Privacy Principles in the Privacy Act 1988 (Cth), as amended or replaced from time to time;
- any applicable privacy code approved under the Privacy Act 1988 (Cth); and
- any other applicable laws or codes governing Personal Information.
Privacy Policy means Job Matcher’s privacy policy which is published at https://jobmatcher.app/privacy and may be updated form time to time without notice to you.
Profile means a Job Seeker or Employer profile created by a User on the Site, under an Account.
Resume means a document or information relating to a Job Seeker and provided by that Job Seeker which outlines a Job Seeker’s background, skills, qualifications, expertise and/or experience.
Site means Job Matcher’s online and mobile services and websites, including applications, and any software, service, feature (including plug-ins and integrations), program or element (including email messages, notifications, and other messages) provided by or on behalf of Job Matcher on or in connection with such services or websites.
Terms mean these website use terms relating to the Site.
User, You or you means any person or entity who accesses or uses the Site, including Job Seekers, Employers and their employees, contractors and agents.
User Content means any Content that a User submits, posts, displays, or otherwise makes available or provides to Job Matcher on or through the Site. User Content includes Job Seeker Profiles and Resumes.
