This privacy policy may be updated by Job Matcher from time to time.  If we update this privacy policy, we will publish the updated version at https://jobmatcher.app/privacy.  It is the responsibility of users and visitors of our website and platform to review this privacy policy periodically and confirm their agreement with it. 

Introduction

Protecting your privacy is important to Your Training Zone Pty Ltd (ACN 607 484 855) (ABN 90 607 484 855) trading as Job Matcher (Job Matcher, we, us, our). 

Job Matcher is an Australian online recruitment marketplace.  Job Matcher allows a job seeker who is a registered user of our platform (Job Seeker) to upload their resume and other information (including personal information) which can then be searched and browsed by an employer who is a registered user of our platform (Employer) and who is looking for a Job Seeker to fill an employment role. 

This privacy policy applies to all users and visitors of the Job Matcher platform and website, including but not limited to Job Seekers and Employers.

This privacy policy also applies to all individuals who provide personal information to Job Matcher, including but not limited to applicants for jobs within Job Matcher, however this privacy policy will not apply to employees of Job Matcher.

Job seekers have some discretion over the types and amount of personal information they make available to Employers, however a minimum amount of personal information will be required in order to allow a Job Seeker profile to be made available to Employers.  If you are a Job Seeker and you wish to restrict the provision of your personal information to only those employers you approve of (for example because you require certain personal information such as your face, name and suburb of residence to remain entirely private), Job Matcher is not an appropriate job finding platform for you. 

We are committed to maintaining the security of all personal information provided to us, whether by individuals or organisation, visitors to and users of our platform and website and social media accounts or otherwise.  However, there is an inherent risk when you share your personal information on the Job Matcher platform and website that such personal information will fall into the hands of third parties and be used for unlawful purposes.  If you do not wish to take this risk, Job Matcher is not an appropriate job finding platform for you.

This privacy policy details how we collect, use, disclose and manage personal information.  We may vary this privacy policy from time to time by publishing an updated privacy policy on our website.

Our collection, use, disclosure and management of personal information is subject to the Privacy Act 1988 (Cth) (the Privacy Act) and the Australian Privacy Principles contained in that legislation.

How is personal information collected?

Where possible, we will collect personal information directly from you or a person authorised to provide your personal information on your behalf. 

We collect your personal information directly when you register and create a profile or account with us, use any of our services or simply visit our website or use our platform.

If you are Job Seeker, we collect personal information from you when you set up a Job Seeker profile.

We also collect personal information ourselves, when you interact with our website and platform.  We might do this when you visit our website (including via cookies and other technologies) or use our products and services, including communicating with our support team.  We may also create or infer information about you using information we hold.

We may also collect personal information from competition or trade promotion lottery entries we receive.  

Should we collect your personal information from a third party, we will take reasonable steps to ensure that the third party has obtained your consent to provide your personal information to us.

When using our website, certain information can be passively collected using various technologies such as cookies, internet tags, and navigational data collection. For example, we may collect information about the date, time and duration of visits.  This information is generally not linked to the identity of visitors, except where our website is accessed via a link in an email.

What types of personal information are collected?

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable. 

If you are a Job Seeker, we seek to collect the following categories of personal information:

  • photographs of your face;
  • your education history, including schooling, training, TAFE and university attendances;
  • your education results;
  • career-related things you hold, such as qualifications, licenses, diplomas, accreditations, certificates and degrees;
  • your employment history; and
  • references, statements of service and other personal information relating to your employment history.

(collectively, Resume Information)

If you are a Job Seeker, Job Matcher generally does not seek to collect sensitive personal information from you, such as:

  • health information and vaccination status;
  • information relating to your criminal history; and
  • your racial or ethnic origin, political opinions or associations, religious or philosophical beliefs, trade union membership or associations or sexual orientation or practices.

Should you liaise with an Employer you contact as a result of using our website or platform, that Employer may request that you provide it with your personal information and/or sensitive personal information.  Your provision of personal information and/or sensitive personal information in such circumstances will be entirely at your discretion and own risk.  Job Matcher does not warrant or represent that an Employer will act lawfully when handling your personal information or sensitive personal information and you acknowledge that you are responsible for vetting any Employer before you provide such information.  We are not responsible for any breach of privacy committed by an Employer after you provide personal information or sensitive personal information to that Employer through our platform or website, or in connection with your use of our platform or website.

More generally, we collect various types of personal information from users of our website and platform, including:

  • your name, date of birth, email address, mobile telephone number, residential and business/work addresses;
  • your preferences in relation to the services we offer, or may offer in the future;
  • your payment details (such as bank account and credit card details);
  • information about how you interact with our website and platform, including the pages you visit, the time and duration of visits and information submitted pursuant to any forms you complete; and
  • in relation to applicants for jobs with Job Matcher, their work history and qualifications.

How do we use or disclose your personal information?

Your personal information is used or disclosed by us for the following primary purposes:

  • to provide you or an Employer you work for or represent with services, including but not limited to assisting and enabling Employers to search for and contact Job Seekers and to process financial transactions with you;
  • to verify you as a registered user of our platform;
  • fraud, crime or misconduct identification, investigation and prevention activities;
  • development, analysis and business intelligence functions relating to our platform and website;
  • our marketing and promotional activities and those of our service providers and advertising partners;
  • to display targeted advertisements to you on our platform or website;
  • to provide you or an Employer you work for or represent with news, updates, event invitations, marketing materials and surveys relating to Job Matcher and the services which we offer;
  • to provide you or an Employer you work for or represent with support relating to our platform and website;
  • our internal analysis and training;
  • for the purposes of complying with our legal obligations; and
  • where you are a job applicant seeking employment with Job Matcher, for assessing your suitability for an employment role with us.

If you are a Job Seeker, we will use your Resume Information, along with other factors, to assess how suitable you are in comparison with other Job Seekers in relation to one or more Employers.  Your Resume Information (including all personal information contained within) will be shown to Employers when searching for and viewing your Job Seeker profile.

As a Job Seeker, your Resume Information may be subjected to automated processing and use by artificial intelligence, in order to evaluate and display your suitability in relation to an Employer and any employment roles they wish to fill.

Additionally, we may use and disclose non-sensitive personal information for secondary purposes, where:

  • you would reasonably expect us to use or disclose personal information for the secondary purpose; and

 

  • the information is related to a primary purpose for which it was collected.

If you do not provide personal information requested of you to us or, withdraw your consent to our use and disclosure of your personal information at any time, we may be unable to provide you with the goods or services you have requested or contact you in the future.  Additionally, where we are required by law to retain personal information, we may refuse your withdrawal of consent to our use and disclosure of your personal information, to the extent permitted by law.

Direct marketing

We may use your personal information for direct marketing to you.  Such marketing communications may include information on services which may be of interest to you.  You may opt out of direct marketing at any time.

If you no longer wish to receive direct marketing communications from us, you may unsubscribe by contacting us on the details set out below.  For communications sent by email or other electronic means you will also be able to unsubscribe using the unsubscribe mechanism in the message itself.

When is personal information used by, or disclosed to, third parties?

Personal information will only be used by, or disclosed to, third parties if it is required in accordance with the primary and/or secondary purpose(s) for which it was collected.  This can include use by, or disclosure to, the following third parties:

  • Job Matcher’s staff members, on a need to know basis;
  • associated body corporates of Job Matcher, so that our associated body corporates may use and disclosure your personal information for the same purposes as we may do under this privacy policy;
  • where necessary, to third parties which provide services to us, such as professional service providers, marketing and advertising agencies and information technology providers;
  • to third party
  • to relevant third parties in the event that we sell, buy or merge any business or assets, including to the prospective seller or buyer of such business or assets; and
  • to the agents and/or employees of those entities listed above, to the extent such agents and employees have a need to know the relevant personal information.

We may share your personal information with third parties, such as our service providers, contractors and advertising partners from time to time for the purposes of:

  • assisting us to provide services we offer you;
  • enabling you to access the goods or services they may offer you; and
  • conducting surveys, trials and customer research.

Disclosure of personal information to third parties located outside Australia

Personal information may be disclosed to third parties located outside Australia who provide information technology services to us, such as software and data storage providers.  We will only do this where we reasonably believe:

  • such third parties are subject to a law or binding scheme that has the effect of protecting your personal information in a way that, overall, is at least is substantially similar to the way in which the Australian Privacy Principles protect your personal information; and

 

  • there are mechanisms you can access to take action to enforce that protection of the law or binding scheme.

Provision of personal information in other situations

We may provide personal information to a third party in accordance with the Privacy Act where we are obligated or authorised to do so.  This may include provision of personal information to a third party:

  • where its provision is required or authorised by, or under, an Australian law or the order of a court or tribunal;

 

  • where we reasonably believe that the provision is reasonably necessary for one or more enforcement related activities conducted by, or on behalf of, an enforcement body; and

 

  • where an applicable permitted general situation applies (as defined in the Privacy Act), for example, to lessen or prevent a serious threat to the life, health or safety of any individual.

Security

We take reasonable technical and organisational security measures to protect personal information from accidental or unlawful destruction, accidental loss and unauthorised access, destruction, misuse, modification or disclosure.  However, there is an inherent risk when you share your personal information on the Job Matcher platform and website that such personal information will fall into the hands of third parties and be used for unlawful purposes. 

How long do we hold your personal information

We hold your personal information for as long as is necessary to fulfill the purposes for which it was collected and retained as set out in this privacy policy or until you request us to delete it (whichever occurs first).

If you request that we delete your personal information, we will take reasonable steps to delete your personal information from our platform and website.

If you have provided your personal information to an Employer on our platform or in connection with your use of our platform, you will need to contact that Employer directly to request that your personal information be deleted.

Notwithstanding your request that we delete your personal information, we may still retain it for a reasonable period of time if is reasonably necessary for us to do so in order to comply with legal and regulatory obligations, resolve disputes between registered users, fraud, crime or misconduct identification, investigation and prevention activities, storage and use in testing or backup systems or to enforce this privacy policy or any other terms and conditions you have agreed to.

Access and correction of personal information held by us

You can gain access to your personal information by contacting us on the details set out below. 

We wish to ensure the personal information we hold about you is complete, accurate and up to date.  Accordingly, you may request that we correct or update your personal information at any time.

We will require proof of identity and reasonably specific details on what you require before actioning such a request to access or correct personal information.  Upon receipt of a compliant request to access or amend personal information, we will endeavour to action such a request within a reasonable period of time.
